Terms of Service
User agreement for using SDBaja.
Eligibility (18+)
You must be at least 18 years old to create an account or use SDBaja. By registering, you represent that you meet this requirement.
Accounts
You are responsible for your account, password, and the accuracy of information you provide. Do not share credentials or impersonate others. Keep contact details reasonably current so we can reach you about safety or account issues.
User content
You may post text, photos, comments, profiles, listings, ride/event details, and related content. You retain ownership of your content. You grant SDBaja a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute that content solely to operate and improve the service (for example, showing a post in the feed or a listing in the marketplace). You can remove content you control, subject to ordinary caching, backups, and legal or safety retention.
Conduct
You agree to follow the Community Guidelines. Harassment, threats, hate, spam, scams, illegal activity, sexual exploitation, content involving minors, doxxing, and similar abuse are prohibited.
Private messaging
Private messages are for legitimate community use. Repeated unwanted messages, threats, or harassment via DM may lead to restrictions. Do not use messaging to solicit illegal activity or commit fraud.
Marketplace
Marketplace listings are between users. SDBaja is a platform and is not normally the seller or buyer, does not process payments unless explicitly stated for a specific feature, and does not guarantee titles, condition, ownership, or delivery. Follow Marketplace Safety guidance and report scams.
Rides, events, crews, and location
Rides, events, and crews are organized by users or hosts, not by SDBaja unless we expressly say otherwise for a specific listing. Location information you share (including meeting points or area labels) is your responsibility. Share precise locations carefully. Off-road and in-person meetups involve inherent risks that you voluntarily assume.
No guarantees
SDBaja does not guarantee the identity, conduct, skill, or legality of users; the accuracy of listings, trail updates, vehicles, events, or locations; or the safety of any trail, vehicle, or meetup. Conditions change without notice.
Your compliance duties
You are solely responsible for licenses, registration, insurance, equipment, border and park rules, and all legal compliance related to your activities.
Moderation
We may remove content, limit features, suspend, or terminate accounts that violate these Terms or Guidelines, or that create safety, legal, or operational risk. We may preserve records needed for security, fraud prevention, legal process, or moderation.
Copyright complaints
If you believe content on SDBaja infringes your copyright, contact contact@sdbaja.com with enough detail to locate the material and verify your claim. We may remove or restrict content while reviewing.
Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, SDBAJA DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SDBAJA AND ITS OPERATOR WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR FROM OFF-ROAD OR IN-PERSON ACTIVITIES. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNTS YOU PAID TO SDBAJA FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM (IF ANY). Some jurisdictions do not allow certain limitations; in those cases, limits apply to the fullest extent allowed.
Indemnification
You agree to defend and indemnify SDBaja and its operator against claims arising from your content, your use of the service, your meetups or rides, or your violation of these Terms or applicable law.
Governing law and venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Exclusive venue for disputes is in the state or federal courts located in San Diego County, California, unless applicable law requires otherwise. These Terms do not include mandatory arbitration or class-action waivers.
Updates
We may update these Terms. Material changes to Terms will require renewed acceptance before you continue to post, message, sell, or RSVP. Continued browsing alone after a material Terms change does not constitute acceptance of the new Terms for those gated actions.
